In order to submit a claim under the Business Equipment Purchase Protection program, certain eligibility guidelines must be met. Please take a minute to review the following list to determine if you are eligible to submit a Business Equipment Purchase Protection claim. This program only applies to eligible items with an auction listing end date of June 2, 2005 or later.
The item must be legal and in accordance with eBay's User Agreement.
The item must have been listed in a designated Capital Equipment category on eBay Business, and not in another category, or on another site.
You, the item, the seller and the person or institution to whom you made payment must all have been located in one of the fifty United States at the time of the transaction and at the time payment is made. Any transaction in which payment is sent outside of the U.S. is not eligible for coverage.
You must have purchased your item via eBay in one of the designated Capital Equipment categories, e.g., a purchase in which you are identified as the winning bidder or fixed price buyer on a closed item. This does not include being the high bidder on a reserve priced auction where the reserve price has not been met.
The winning bid amount of your item must have been over $1,000. Every case requires a $200 buyer co-pay.
Both you and the seller must have had a net eBay feedback rating of zero or above at the end of the listing and have not been suspended at the time of the transaction.
You must not have filed another claim, resulting in a paid claim, in the 6 months prior to the listing's end, and only one piece of equipment may be included in any one claim.
You must have been defrauded by the seller. The seller must have intentionally and materially misrepresented the item you purchased in the item's listing on eBay or in some other form of written communication to you, including email. Business Equipment Purchase Protection is not recourse for buyer's remorse or a replacement for a buyer doing careful research before making a purchase.
You must have tried to work things out with the seller first. Simple misunderstandings are often worked out through direct communication. To contact your trading partner, go to the Find Members page.
You must wait 14 days from the end of the listing, but no more than 3 days after your receipt of the item, before filing a claim. This allows time for you to contact the seller and give them an opportunity to take care of the problem.
If your item was paid for with a credit card you must contact your credit card issuer prior to filing a claim. If your credit card issuer denies your claim you may be entitled to file a claim under Business Equipment Purchase Protection. (You will be required to show proof that your claim was denied by your credit card issuer.)
Any coverage available under the Business Equipment Purchase Protection program shall be excess over any coverage or recovery provided by any other valid and collectible insurance policy or any other source of recovery held or collectible by any claimant under the Business Equipment Purchase Protection program.
Your claim must be received by the third party provider within 30 days of the end of the listing, and no more than 3 days after your receipt of the item. Exceptions to this rule are undisclosed lien or stolen item claims, for which you will have up to 6 months from the end of the auction in which to file a claim.
