You can sell collectible tobacco packaging and some tobacco-related items, as long as you meet certain conditions. However, you're not allowed to sell most tobacco products on eBay because of strict government regulations. For details on what can and can't be listed, see our guidelines.
Our tobacco policy only applies to items sold on the U.S. eBay website (eBay.com). Our international websites may have different rules, so be sure to check each country's website to see what's allowed. Be sure to also follow our international trading policy.
If you're selling an item that's allowed, you can only offer domestic shipping. You're not allowed to ship items outside the U.S.
Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account.
What are the guidelines?

Collectible packaging that's completely empty (no tobacco inside the package)
Restricted
Collectible packaging that contains tobacco can be listed as long as the package has never been opened, is completely sealed, and you follow and include all of these statements in your listing. We recommend copying and pasting the following list into your item description. Be sure to use the same font size as the rest of your description.
– The value of the item is the collectible packaging, not the tobacco itself. – The value of the packaging is higher than the current retail price of the tobacco in the package. – While the package has never been opened, the tobacco inside is not for consumption. – The collectible packaging is not currently available in stores. – The buyer must be at least 18 years old. (As the seller, I'm responsible for making sure this rule is met.) – Both the buyer and the seller are following all applicable laws and shipping regulations for this transaction.
If you include photos in your listing, you have to show the actual item for sale—no stock photos allowed.

Cigars in cellophane wrapping
Collectible tobacco, including listings that describe the tobacco instead of the collectible packaging
Tobacco products packaged in classic packaging
Allowed
Nicotine patches or gums
Promotional items with tobacco brand logos, such as calendars, hats, and shirts
Memorabilia, posters, or similar items (including vintage) for tobacco products
Tobacco seeds
Vintage ads for tobacco products
Restricted
Cigar bands and packaging can only be listed individually if they don't include actual tobacco
Coupons, rebates, or reward codes that can be used for purchasing tobacco, tobacco products, or tobacco accessories like lighters or pipes can be listed, but make sure your listing follows the guidelines in our manufacturer's coupons policy.

Domain names or web addresses for websites that aren't working or are no longer active
Not allowed
Domain names or web addresses for websites that sell tobacco

Why does eBay have this policy?
Because selling tobacco is highly regulated, most tobacco items can't be sold on eBay. Be sure to follow all applicable laws, regulations, and our policies.
