For legal reasons, we don't allow the sale of tobacco, cigars, cigarettes (of any type, not limited to tobacco), smokeless tobacco, or coupons for tobacco items.
Tobacco-related collectibles can be sold if sellers follow our specific policy guidelines below.
Violations of this policy may result in a range of actions, including:
Limits on account privileges
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
International tobacco sales
This tobacco policy only applies to items sold on the U.S. eBay website (eBay.com). Our international websites may have different rules, so be sure to check each country's site to see what is allowed there and make sure you follow our international trading policy.
Collectible tobacco packaging
We realize that some collectible packaging does contain tobacco, but these items can still be sold if all of these conditions are both stated in the listing and followed:
The value of the item is the collectible packaging, not the tobacco itself.
The listing description states that the package has not been opened, but that the tobacco inside is not for consumption.
The collectible packaging must not be currently available in stores, and the value of the packaging must be higher than the current retail price of the tobacco in the package.
Sellers must take steps to ensure that the buyer is at least 18 years of age.
Buyers and sellers must follow all applicable laws and shipping regulations for this transaction.
Other things to note:
New tobacco products packaged in a classic packaging are not considered collectible by eBay and can't be listed.
Cigars in cellophane wrapping aren't considered to be in collectible packaging.
Tobacco coupons & websites
Most coupons for tobacco products aren't allowed. Coupons that are allowed under the tobacco policy also need to follow our manufacturer's coupons policy.

Why does eBay have this policy?
We urge sellers and buyers to comply with all laws and regulations. Because selling tobacco is highly regulated, sellers are restricted in their listing of it on eBay.
