Electronic Surveillance Equipment
eBay does not permit the sale of products that are designed primarily to record the private oral, wire or electronic conversations of others without their knowledge or permission. These small, easily hidden transmitting devices are illegal to possess or sell under Title 18, United States Code Section 2512, and their use also violates the law in many states and countries.

Limits on account privileges
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status

Several states (including California) prohibit the use of photographic devices to surreptitiously view or record individuals for sexual purposes. Listings that promote such activity are not permitted on eBay. See an example of such laws.
Why does eBay have this policy?
Member privacy is a building block of the eBay community. eBay treats member privacy rights with great respect. eBay expects community members to treat privacy with the same level of respect. Furthermore, eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of electronic surveillance equipment is prohibited by law, or may cause harm to eBay or its members, sellers are not permitted to list them on eBay.
