Reproduction Political Memorabilia Sellers listing items in the political categories must protect potential buyers by abiding by the Hobby Protection Act. Sellers must also be aware of this law to protect themselves from any violations of Federal law which could impose fines, penalties, or both.

Additional Information U.S. Federal law strictly prohibits the sale of reproduced political memorabilia if it is not legibly marked with the date of manufacture. This prohibition applies to all political items, including buttons, posters, literature, stickers, or other forms of political advertisements and candidate promotions. This law, the Hobby Protection Act, 15 U.S.C. § 2101 et seq., and 40 F.R. § 5496 protects collectors against fraud or confusion and also places sellers on notice of Federal mandates regarding reproduced items. Why does eBay have this policy? eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of political memorabilia is highly regulated, or may cause harm to eBay or its members, sellers are urged to educate themselves on the laws surrounding it to ensure they are in compliance.
