Cell phone service contracts may be sold on eBay alone or bundled with a phone.
Sellers listing a phone bundled with a required service contract must:
List only in the Phones with New Plan Purchase section of the Cell Phones category.
Be an authorized reseller of cell phone services.
Offer a full refund within 10 days of payment to any buyer who is rejected for a service contract.
Clearly state in listings what regions, states or zip codes of the country are serviced and any restrictions buyers may encounter.
Offer and include the following text in all bundled listings:
"As an authorized reseller of cell phone services, I will provide a full refund within 10 days to any buyer that does not qualify for our service. This may occur if the buyer is located outside the area that I am authorized to resell or if the buyer is rejected for other reasons such as not passing our credit requirements.
To fully understand our coverage area and policy, please read our terms and conditions in each listing carefully."
Note: Sellers who decline to offer service to a buyer are not eligible to receive a final value fee credit from eBay through the Unpaid Item process.
Violations of this policy may result in a range of actions, including:
Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
“Brand New Motorola cell phone, activation required” listed in the “Cell Phones—Phones with New Plan Purchase” category and including the text above is permitted.
Why does eBay have this policy?
This policy permits sellers to list phones with service contracts. It also ensures sellers offer an alternative to buyers in the event that it is later discovered that the service cannot be provided.
