In addition to the Rewards as described in Section 4 of the eBay Bucks Rewards Program Terms and Conditions, you may also be able to earn additional Rewards based on a Qualifying Seller Action, defined below ("Seller Rewards"). Seller Rewards means a U.S. dollar amount which will be given in the form of an eBay Bucks Certificate and will be attributed to the Eligible Participant's eBay account upon the following criteria:

1. Only Eligible Participants who are the intended recipients of an invitation from eBay to participate in the eBay Bucks Sales Promotion ("Sales Promotion") may receive Seller Rewards in connection with such promotion;
   
   
2. The Sales Promotion starts on November 17, 2009 and ends at 11:59 p.m. PST on December 16, 2009 ("Sales Promotion Period");
   
   
3. For the Sales Promotion, the Eligible Participant can earn up to $200 in Seller Rewards for each transaction, regardless of the number of items purchased in that transaction;
   
   
4. "Qualifying Seller Action" occurs if an Eligible Participant who was the intended recipient of the Sales Promotion invitation properly lists an item for sale on www.eBay.com on or after November 17, 2009 and such item is purchased and paid for with PayPal on or before December 16, 2009 in any category, excluding:
   

   	4.1.1	All categories in Motors (www.motors.ebay.com) except Parts &Accessories because Parts &Accessories are included in this Sales Promotion,
   	4.1.2	Classifieds,
   	4.1.3	Real Estate, and
   	4.1.4	Business & Industrial Capital Equipment, including the following capital equipment categories and the related subcategories: Agriculture & Forestry > Tractors & Farm Machinery; Construction > Heavy Equipment, Trailers; Food Service & Retail > Concession Trailers & Carts; Healthcare, Lab & Life Science > Imaging & Aesthetics Equipment; Industrial Supply, MRO > Fork Lifts & Other Lifts; Manufacturing & Metalworking > Manufacturing Equipment; Manufacturing & Metalworking > Metalworking Equipment; Office, Printing & Shipping > Commercial Printing Presses.

   
   
5. Items listed and purchased by the same Eligible Participant do not constitute a Qualifying Seller Action and such Eligible Participant will not be eligible for Rewards;
   
   
6. "Qualifying Sales" means the cumulative total of final sales prices of Qualifying Seller Actions;
   
   
7. Qualifying Sales excludes sales tax, shipping charges, discounts, partial refunds, free items, items that fail to comply with applicable eBay terms and conditions, past purchases, and non-shipped, undeliverable or returned items;
   
   
8. For returned or otherwise refunded items, eBay will reduce an Eligible Participant's Rewards balance (even if the item was returned or refunded after the Eligible Participant already redeemed Rewards for such item) and this may result in a negative Rewards balance;
   
   
9. Seller Reward amount will be comprised of the base earn which is calculated as a percentage (as stated in the Eligible Participant's invitation) of Qualifying Sales plus any limited-time promotional offer(s) that eBay, in its sole discretion, may offer to Eligible Participants;
   
   
10. If the Qualifying Sales were for items listed on www.ebay.com in foreign currencies, the Seller Reward amount will be calculated based on the exchange rate available to eBay at the time of payment;
    
    
11. Seller Rewards are capped at $500 in Seller Rewards for each Eligible Participant (regardless of the number of eBay accounts used by such Eligible Participant);
    
    
12. Seller Rewards are a subset of Rewards so regular Rewards and Seller Rewards will be combined in the Eligible Participant's account and on the eBay Bucks Certificate and accordingly, all terms and conditions that apply to Rewards (including caps on earnings) will also apply to Seller Rewards;
    
    
13. Seller Rewards may not appear in the Eligible Participant's eBay Bucks account until seven (7) days after the Sales Promotion Period ends;
    
    
14. Seller Rewards will be tied to the eBay account of the Eligible Participant and Seller Rewards cannot be combined across accounts;
    
    
15. Unused Seller Rewards on an eBay Bucks Certificate are forfeited when the eBay Bucks Certificate expires; and
    
    
16. eBay reserves the right to hold back or otherwise suspend Seller Rewards after listing in its sole discretion to investigate compliance with eBay's policies so Seller Rewards may not post for Qualifying Seller Actions during eBay's investigation and will post if eBay clears the action.
