No Payment via PayPal Necessary to Enter or Win
Sweepstakes is open to legal residents of the 50 United States and the District of Columbia and Canada,
18 years of age and older (or the age of majority in their state or place of residence), who are confirmed registered members of www.eBay.com or www.ebay.ca with a valid eBay User ID as of June 1, 2004.
Void in Puerto Rico and where prohibited.

 
The eBay Payment Sweepstakes ("Sweepstakes") begins at 12:00 AM Pacific Time ("PT") June 1, 2004 and ends at 11:59:59 PM PT June 30, 2004 ("Entry Period").
 
1. How To Enter: During this Entry Period there are two ways to enter the Sweepstakes. [1] To enter when paying your eBay Seller Fees via a one-time PayPal payment: All confirmed registered members of the eBay Site with a valid eBay User ID ("eBay Users") that receive at least one invoice from Sponsor for Seller Fees due to Sponsor are automatically entered in to the Sweepstakes when they pay their total Seller Fees due at such time via a "One-time PayPal Payment" through the PayPal website between June 1, 2004 and June 30, 2004. [2] To enter by mail without paying your eBay Seller Fees via PayPal: To enter by mail without paying your eBay Seller Fees via PayPal: Hand print your name, address, city, state, ZIP or Postal Code, e-mail address, eBay User ID and your day and evening phone numbers on a 3"x 5" card and mail in a #10 envelope to: eBay Payment Sweepstakes, P.O. Box 4053 Grand Rapids, MN 55730-4053. Mail-in entries must be postmarked by June 30, 2004 and received by July 7, 2004. Limit 1 entry per eligible person or eBay User ID, regardless of entry method. eBay, Inc. ("Sponsor") is not responsible for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, illegible entries or postage due mail. No mechanical reproductions of entries permitted. All entries become the exclusive property of Sponsor and are subject to the terms set forth in Sponsor's privacy policy available on www.eBay.com (the "eBay Site") and those provided herein. Payments via the PayPal debit card are not eligible.
 
2. Drawing for Winners/Prize Notification: Potential prize winners will be determined in a random drawing to take place on or about July 15, 2004 from among all eligible entries received during the entry period. Drawing conducted by Marden-Kane, Inc., an independent judging organization whose decisions are final on matters relating to this sweepstakes. Marden-Kane will notify potential winners by email or regular and/or overnight mail. The prize winners will be required to sign an affidavit of eligibility, liability waiver, IRS form W9, and where legal, consent to publicity, properly executed within ten (10) days of issuance. If potential winner is a Canadian resident, he/she will also be required to correctly answer a timed, 4-step arithmetic skill-testing question in order to confirmed as a winner and receive a prize. Quebec residents may submit any dispute respecting the conduct and awarding of a prize in this Sweepstakes to the Regie Des Alcools, Des Courses Et Des Jeux. All prize winners will be required to furnish his/her social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law. If the prize or prize notification is unclaimed or returned as undeliverable, or if a winner fails to properly sign and return all forms described herein, the prize will be forfeited and awarded to an alternate. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any proper names, likenesses, photographs, and/or city/states without further consideration or payment to the entrant online, in print, or in any other media for advertising and promotional purposes for this and similar promotions in all media (including and without limitation, the Internet) without additional compensation, except where prohibited by law. If an entrant changes his/her telephone number, email address and/or street address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to the Sweepstakes Administrator address (listed below) to be received by the end of the Entry Period.
 
3. Prizes: Each winner will receive credits equal to Qualifying eBay Seller Fees (defined below) incurred as a result of listing items for sale on the eBay Site during the period beginning August 1, 2004 and ending July 31, 2005 ("Prize Period"), up to a maximum amount as follows: One (1) Grand Prize Winner will receive credits towards Qualifying eBay Seller Fees up to $25,000, One (1) First prize winner will receive credits towards Qualifying eBay Seller Fees up to $10,000, and One (1) Second Prize winner will receive credits towards Qualifying eBay Seller Fees up to $5,000. Total Approximate Retail Value of all prizes $40,000. Approximate Retail Value of all prizes are reflected in U.S. dollars, however, for CA winners, prizes will be converted to CA Dollars. "Qualifying eBay Seller Fees" include insertion fees, final value fees, feature fees and listing upgrade fees, but not PayPal fees. Credits offsetting the Qualifying eBay Seller Fees will be credited to each winner's eBay account associated with the winning eBay User ID on a monthly basis as a result of listings and sales that are made by each such winner for the corresponding month during the Prize Period. eBay reserves the right to change fees as announced on the eBay Site. The monthly credits will be marked in the winner's eBay account as a "Payment Sweepstakes Credit." A description of the eBay seller fees can be found at http://pages.ebay.com/help/sell/fees.html. To be clear, the prize winners will not receive a credit for any seller fees that exceed the amounts listed above, and the seller fees must be incurred during the Prize Period. You will be reimbursed for your eBay seller fees only if you meet the above requirements as a seller in good standing at all times during the Prize Period. You will not receive a credit for refunded fees. The winner's eBay account must be in Good Standing (defined below). In order for an account to be deemed to be in "Good Standing" as that term is used herein, a hold must not have been placed on the account and the account must not be suspended or past due as of the date on which the prize is awarded or during the Prize Period. No prize substitutions, cash equivalent of prize, or transfer of prizes permitted except that the Sponsor, at its sole discretion, may substitute a prize of equal value for any reason. Prizes cannot be sold bartered, transferred, traded, or used for the benefit of another member, and any winner that attempts to do so will (i) automatically be disqualified, (ii) not receive any additional credits for eBay seller fees and (iii) be required to return any credits for eBay seller fees provided by Sponsor within thirty (30) days. Winners are responsible for payment of all taxes, custom duties or fees on prize and for any other expenses relating to the acceptance and use of the prize not specified herein.
 
4. Eligibility: This Sweepstakes open to all legal residents of the 50 United States and the District of Columbia and Canada, 18 years of age and older or the age of majority in their state or place of residence who are confirmed registered members of www.ebay.com or www.ebay.ca (the "eBay Site") with a valid eBay User ID as of June 1, 2004. Employees of eBay Inc., PayPal Inc. and their respective subsidiaries, affiliates, prize suppliers and advertising and promotion agencies, including Marden-Kane, Inc., and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win. Void in Puerto Rico and where prohibited by law. The Sweepstakes is subject to all applicable federal, state, provincial, municipal and local laws and regulations.
 
5. Limitation of Liability: By participating in the Sweepstakes, entrants agree to abide by the terms of these Official Rules and the decisions of the judges, waive any right to claim ambiguity in the rules, and release, indemnify and hold harmless the Sponsor, eBay Inc., Marden-Kane Inc. and each of their affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, "Releasees") from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize that may be awarded. Entrants agree that any and all disputes shall be governed by the laws of the state of California. Releasees are not responsible for printing or typographical errors in any Sweepstakes related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, access any web site associated with this Sweepstakes, or process any transaction thereon. If in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and / or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the remaining prizes using all eligible, non-suspect entries received as of the termination date. Sponsor reserves the right to modify or terminate the Sweepstakes in its entirety at any time and at its sole discretion. Should the Sweepstakes be terminated or modified prior to the stated expiration date, notice will be posted on https://www.ebay.com/payment/sweeps. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited
 
6. Winners List: For a list of the sweepstakes winners available after July 15, 2004, send your request with a self-addressed, stamped envelope to: eBay Payment Sweepstakes Winners, P.O. Box 6000, Manhasset, NY 11030-6000. Requests must be received by July 15, 2004. Canadian residents may omit return postage.
