1. Description of In-Store Pickup
Sellers selling on eBay (each, a "Seller") may offer the following in-store pickup services on the Site: (i) shipping a remote item to a local store for a buyer to pickup upon receiving notification that the item arrived at the local store (the "Ship to Store Feature" or "STS Feature") and/or (ii) holding an in-stock item for a buyer to pickup at a local store upon receiving notification that the item is ready for pickup (the "Same Day Pickup Feature" and together with the STS Feature, the "Feature(s)"). The Features will provide eBay users with the additional ability to place order(s) on Seller's listings for pickup in the Seller's local store, either on the same day as the purchase or at a later date, as determined by the Seller.
2. Information provided by Seller
You acknowledge that, in connection with the Features, any information regarding order details, item availability, estimated pick-up time, current store hours, phone number, physical address, pickup instructions, Seller's return policy ("Seller's Return Policy"), cancelations policy, and customer support contact information (together, the "Feature Information") are provided by Seller (and not eBay) and displayed on the Site. The display of item availability at a store on the Site (i.e. whether an item is in-stock or available at a store) at a particular time does not imply or warrant that such items are currently or will be available at any time. Item availability and estimated pick-up time are approximate, not guaranteed, may vary based on your location and may not be based on real-time information. All pickup times are subject to the Seller's store business hours.
Seller (and not eBay) is responsible for any customer support and returns as part of the Features. Seller may post the Feature Information on the "Description" section of each Seller listing or on the Seller's eBay Store on the Site. Cancellation of an order that has been placed, if allowed by a Seller, shall be made in accordance with the Seller's cancellation policy. You are responsible for reviewing the Seller's Feature Information and contacting Seller regarding any information that may not be stated on the Site, including any information about a Seller's return or cancellation policy, prior to confirming purchase of the item you wish to buy on the Site. eBay does not make any representation and is not liable for and disclaims any and all responsibility for any content or information relating to the Features, including the Feature Information.
After purchase of an item and selection of a Feature as a fulfillment method, Seller will notify eBay when your order is ready for pickup and eBay will then notify you separately by electronic mail or My Messages ("Pickup Notification"). Seller (and not eBay) is responsible for the time it takes for an item to be shipped to a local store and/or prepared for in-store pickup, as applicable, and for promptly providing notification once your item is ready. You may pickup your order after you receive such Pickup Notification by presenting your pickup code, if applicable, and Pickup Notification [and proper form of identification] at the Seller's store. A purchased item may only be picked up at the store location you selected on the Site.
When you purchase an item, we may provide you with the option to receive your Pickup Notification via SMS or other text messages. For telephone numbers you provide us, including mobile telephone numbers, you consent to receive SMS or other text messages at that number. We won't share your phone number with non-affiliated third parties for their purposes without your consent, but may share your phone numbers with our Family of Companies (i.e., companies that are direct or indirect subsidiaries of eBay Inc. or are otherwise related to eBay through common ownership or control) or with our service providers, such as billing or collections companies, who may contact you using autodialed or prerecorded message calls or text messages. Standard telephone minute and text charges may apply if we contact you.
4. Returns and Refunds
Return of a purchased item through a Feature shall be made in person at the Seller's physical location according to Seller's return policy, as may be stated on the Seller's eBay Store site or in "Description" section of each Seller listing. You are responsible for bringing the receipt you received from Seller to the Seller's store when returning an item.
Some Sellers will allow a refund for an item returned to a local store in person. If a Seller allows a refund of a returned item, upon acceptance by such Seller of your return and notice of such return by Seller to eBay through Seller's point of sale system ("POS system"), eBay shall refund to your PayPal account the monies paid by you for the Seller Listing. PayPal refunds are generally processed within 2 business days of our receipt of notification of the returned item, but please allow up to 2 weeks for funds to be returned to you. eBay shall not be responsible for any refunds to you if eBay does not receive a confirmation from Seller's POS system of the return of your purchased item. Refunds sent through an eBay service (e.g. PayPal) for returns will be made to you via the method described in this paragraph only.
Some Sellers may allow returns for in-store credit only or refunds via another method as stated on the Seller's Return Policy. Exchanges will be processed as a return or pursuant to the Seller's policy on exchanges, if any.
You are responsible for reviewing a Seller's Return Policy prior to purchasing an item on the Site. All item returns purchased in connection with a Feature shall be handled by Seller and not eBay and are subject to Seller's Return Policy.
If you choose to submit an eBay Buyer Protection claim for a purchased item whereby either of the Features were chosen as a method of delivery, you agree to first try to return the product in accordance with the Seller's Return Policy and only submit such eBay Buyer Protection claim if Seller fails to process your return or rejects your return. The acceptance of or willingness to accept a return by a Seller for an exchange or store credit in lieu of a cash refund will not be deemed a failure by the Seller to process your return or a rejection of your return. All eBay Buyer Protection claims will be reviewed and processed in accordance with eBay's Buyer Protection policy.
In connection with the Features, eBay will show a map (from a third party provider) on the eBay site of certain physical store locations of the Seller in relation to the location of the Buyer. eBay is not liable for and disclaims any and all responsibility for any content or information in the map or content related to any of the Seller's store locations, including any address or distance related information or any other information derived from map related content. Any display of miles to store on the Site are approximate only, not guaranteed and may vary based on your location. eBay does not make any representations regarding any display of miles to store.
6. Disclaimer of Warranties
eBay disclaims responsibility for any harm resulting from your use of the Features or from your pickup experience, including, without limitation, your travel to Seller's local store and your interactions with Seller and Seller's facilities. The Features are provided "as is" and "as available". eBay expressly disclaims to the fullest extent permitted by law all express, implied and statutory warranties, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement of proprietary rights, and any warranties regarding the security, reliability, timeliness and performance of the Features.
