2) Drawing for Winners: Potential prize winners will be determined in a random drawing to take place on or about October 15, 2003, from among all eligible online and write-in entries received during the entry period. Drawing conducted by Marden-Kane Inc., an independent judging organization whose decisions are final on matters relating to this sweepstakes. Marden-Kane will notify potential winners by email or mail. The Grand Prize winners will be required to sign an affidavit of eligibility, liability release, and where legal, consent to publicity, and winner travel release form, properly executed within ten (10) days of issuance. Failure to sign & return affidavit in time noted will result in disqualification of entry & an alternate winner[s] will be selected. The Grand Prize winners will be required to furnish his/her social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law. If the prize or prize notification is unclaimed or returned as undeliverable, or if a winner fails to properly sign and return all forms described herein, the prize will be forfeited and awarded to an alternate. 3) Prizes: Five (5) Grand Prizes will be awarded: A trip for one (1) winner to eBay Headquarters in San Jose, CA. The trip includes round trip air transportation for winner only, from a major U.S. airport closest to winner's home (unless the winner lives within a reasonable driving distance), hotel accommodations for one (1) for one (1) night (standard single occupancy room), a behind the scenes tour of the eBay campus, lunch with a senior eBay executive, a 6-month Seller Manager Pro subscription, Free StoreBasic Store (1 Year) or Featured Store (2 months), and a pair of PowerSeller Pajamas. Approximate Retail Value (ARV): $1,237. Value will vary dependent upon city of departure. Travel must be completed by October 30, 2004 on a date that is mutually agreed upon by eBay and winner or prize will be forfeited. In the event that the day at eBay is cancelled for any reason whatsoever, the Sponsor shall have no further obligation to the winner other than to award a trip to San Jose, CA for one (1) night and two (2) days, subject to the terms and conditions of acceptance provided by Sponsor at such time. In addition, the winner is responsible for obtaining travel insurance (and all other forms of insurance), at their option, and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Prizes awarded subject to availability and Sponsor reserves the right, at its sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. 4) Eligibility: This Sweepstakes is open to all legal U.S. residents, 18 years or older who are registered eBay PowerSellers at time of entry (mail-in entrants need not be a PowerSeller at time of entry). Employees of eBay Inc., and its respective subsidiaries, affiliates, prize suppliers and advertising and promotion agencies of eBay Inc., including Marden-Kane, Inc., and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win. Void in Puerto Rico and where prohibited by law. This Sweepstakes is subject to all applicable federal, state, local laws and regulations.

6) Additional Terms and Conditions: Releasees are not responsible for printing or typographical errors in any Sweepstakes related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to subscribe to use Selling Manager or access any web site associated with this Sweepstakes, or process any transaction thereon. If in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the remaining prizes using all eligible, non-suspect entries received as of the termination date. Any attempts by an individual to access any web site associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited. Entrants agree that any and all disputes shall be governed by the laws of the state of California.
