Multi-User Account Access User Agreement

Thank you for your interest in eBay's Multi-User Account Access program (the "Program"). Please read the following carefully as it affects your legal rights.

The Program is provided solely for the purposes laid out below. If eBay believes you or your Delegatees are using the Program in any way that undermines eBay's business interests, eBay may, at its sole discretion, terminate these Terms, suspend your eBay account, and discontinue your participation in the Program. These Terms of the Multi-User Account Access User Agreement ("Terms") govern your participation in the Program and take effect the date you signify your agreement.

You are contracting with an eBay company (individually and collectively referred to as "eBay", "we", or "us") determined by your country of residence as laid out in the Applicable User Agreement that governs your contractual relationship with eBay.

1. Definitions

Delegator — means the person who is delegating or assigning specific functions to be performed.

Delegatee — means the person(s) who has agreed to perform specific delegated or assigned functions on behalf of the Delegator.

Program — means the Multi-User Account Access Program.

eBay Platform — means the eBay website, including any eBay content therein, and all other applications and content.

Any definition used in the User Agreement has the same meaning in this document.

2. User Guidelines

We've established a few ground rules for using the Platform, to make sure that experience works well for everyone. You must follow these rules and encourage others to do the same.

  1. By inviting the Delegatee to participate, the Delegator must agree to allow Delegatee to access certain functionalities associated with the Delegator's account.
  2. The Delegator can specify certain permissions which are functions or operations that can be carried out by the Delegatee in the name of the Delegator.
  3. The Delegator assigned permissions can be revoked by the Delegator at any time and without any prior notice.
  4. The Delegator has the right to add or remove Delegatees at any time.
  5. The Delegator has the right to reassign, add or delete the permissions assigned a Delegatee at any time and for any reason.
  6. The Delegator is required to maintain oversight of the permissions delegated to the Delegatee.
  7. The Delegator must revoke access within a reasonable amount of time when the relationship between the Delegator and Delegatee is concluded. Ebay shall not be responsible for revoking Delegatee access.
  8. The Delegator is responsible for all the actions of the Delegatee while acting on behalf of the Delegator. The Delegator must notify eBay immediately, if they learn of any action by the Delegatee that could harm the Platform or eBay's business or eBay's users.
  9. In order to participate in the Program, Delegatee agrees to access Delegator's account in accordance with the eBay User Agreement and these Terms.
  10. It is your responsibility to explain your data processing activities in your own privacy notice. Relevant information about our handling of our users', including the Delegatees', personal data can be found in our User Privacy Notice on the eBay Platform of which you must inform the Delegatees if required under applicable laws. You must in any case comply with the applicable data protection laws and in particular protect the rights of the Delegatees as data subjects.
  11. The Delegatee is authorized to access the Delegator's account only to perform specific permissions assigned by the Delegator.
  12. The Delegatee is required to maintain an active, valid eBay account.
  13. The Delegatee has the responsibility to take all reasonable measures to protect Delegator data. If the Delegatee learns that Delegator data has been compromised, they must notify the Delegator and eBay customer support within a reasonable time.
  14. The Delegatee is not allowed to forward, sell, sub-lease, or otherwise transfer their assigned responsibilities as a Delegatee.
  15. The Delegatee, while accessing delegator's account, should only act on behalf of the assigned Delegator.
  16. The Delegatee is required to provide notice to the Delegator upon ending relationship with Delegator.
  17. The Delegatee is required to act in accordance with eBay's User Agreement and policies and any other applicable laws and regulations.
  18. The Delegatee is bound by all agreements and policies agreed to or consented to by the Delegator with eBay.

3. General Guidelines

  1. eBay has the right to suspend or revoke access to the Program at any time without notice.
  2. eBay provides the Program to facilitate more efficient selling, but eBay is not responsible or accountable for the actions of the Delegator or the Delegatee.

4. Modifications

  1. eBay may modify the Program, any of the benefits and/or features provided in connection with your use of the Platform at any time with or without notice to you.
  2. eBay may amend these Terms at any time.

5. Indemnification

The Delegatee will indemnify and hold eBay (including our affiliates and subsidiaries, as well as our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by a delegator or any third party due to or arising out of your breach of this User Agreement, your improper use of the MUAA platform, eBay's Services or your breach of any law or the rights of a third party.
