How To Enter the Sweepstakes:
The eBay Treasure Hunt Sweepstakes ("Sweepstakes") begins at 12:01 AM Pacific Time (PT) February 16, 2005 and ends at 11:59 PM PT February 23, 2005 ("Entry Period"). You will receive one (1) entry into the Sweepstakes when you bid on, purchase, or list an item on www.ebay.com or www.ebaymotors.com during the Entry Period (each a "Qualifying Transaction"), for up to a maximum of one entry each day. Purchases, bids and listings in eBay Live Auctions, Giving Works (Charity), and Professional Services shall be excluded and will not be considered Qualifying Transactions. eBay.com and eBayMotors.com shall each be referred to herein as an "eBay Site". The then-current user agreements that govern use of the eBay Sites are hereby incorporated herein by reference.
(B) To enter the Sweepstakes by mail without bidding on, purchasing or listing an item:
Hand print your name, address, city, state, zip, e-mail address, eBay user ID (optional) and your day and evening phone numbers on a 3"x 5" card and mail in a #10 envelope to: "eBay Treasure Hunt Sweepstakes", P.O. Box 4319, Manhasset, NY 11030-4319. Non-winners will not be notified. Mail-in entries must be mailed separately and postmarked by February 23, 2005 and received by March 2, 2005. No mechanical reproductions of entries permitted.
Limit one (1) Sweepstakes entry per person and/or eBay User ID, per day, regardless of method of entry. eBay Inc. ("Sponsor") is not responsible for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, illegible entries or postage due mail. All entries become the property of the Sponsor and will not be returned. All information provided to Sponsor when registering for, and participating in, the Sweepstakes will be used in accordance with Sponsor's then-current privacy policy located on the eBay Site.
Drawing for Sweepstakes Winner:
Potential Sweepstakes prize winner will be determined from among all eligible entries received (transactions and mail-ins) during the entire Entry Period. The drawing will occur on or about March 7, 2005. The drawing will be conducted under the direction of Marden-Kane, Inc., an independent judging organization whose decisions are final in all matters relating to the Sweepstakes.
Prize:
Sweepstakes Prize: One (1) Grand Prize will be awarded. Twenty Five Thousand Dollars ($25,000) in cash and a "Featured" eBay Store subscription for free for life, with the understanding that "life" shall be deemed to mean fifty (50) years. Approximate Retail Value (ARV): $67,000. The prize will be awarded on or about 3/18/05. Prize is subject to availability and Sponsor reserves the right, at its sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. Grand prize winner will receive the then-current version of the "Featured" eBay Store subscription. Grand prize winner acknowledges and agrees that Sponsor may, in its sole and exclusive discretion, change the features, functionalities and/or branding of "Featured" eBay Stores at any time. Only the subscription fee for the "Featured" eBay Store will be included as part of the eBay Store portion of the prize. All costs and fees that are not expressly set forth herein including, but not limited to, taxes and fees charged by eBay and PayPal for use of the eBay Site and paypal.com (the "PayPal Site"), are the sole responsibility of the winner. Odds of winning depend on the total amount of eligible entries received for the drawing. No substitutions or transfers of prize permitted. The cash portion of the Grand Prize will be deposited in the winner's account on the PayPal Site. If the winner does not have an account on the PayPal Site, winner will be required to go to the PayPal Site and create a PayPal account, subject to the terms of the then-current PayPal Site User Agreement at http://www.paypal.com/cgi-bin/webscr?cmd=p/gen/ua/ua-outside.
Eligibility:
The Sweepstakes is open to confirmed registered members of the eBay Site who are legal U.S. residents, 18 years or older at the time of entry (mail-in entrants need not be registered members of the eBay Site). You will not be eligible for the Sweepstakes if your accounts on the eBay Site and PayPal Site are not in Good Standing. In order for your accounts to be deemed in Good Standing as that term is used herein, you must not have a hold on either account and your accounts must not be suspended or past due as of February 23, 2005. Employees of eBay Inc. and its subsidiaries, affiliates, prize suppliers and advertising and promotion agencies, including Marden-Kane, Inc., and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win. Void in Puerto Rico and where prohibited by law. This Sweepstakes is subject to all applicable federal, state, local laws and regulations.
Prize Notification:
Marden-Kane will notify potential winner by telephone, email and/or mail on or about 3/8/05. Winner of prize valued over $600 will be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, which must be returned within ten (10) days after issuance of prize notification or prize will be forfeited. Potential winner will be required to furnish their social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law. If prize notification is unclaimed or returned as undeliverable, or if a winner fails to properly sign and return all forms described herein, the prize will be forfeited and an alternate winner will be selected. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any proper names, likenesses, and photographs without further consideration or payment to the entrant online, in print, or in any other media for advertising and promotional purposes for this and similar promotions in all media (including and without limitation, the internet) without additional compensation, except where prohibited by law.
LIMITATION OF LIABILITY AND GENERAL TERMS AND CONDITIONS:
BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANTS AGREE TO ABIDE BY THE TERMS OF THESE OFFICIAL RULES AND THE DECISIONS OF THE JUDGES, WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE RULES, AND RELEASE, INDEMNIFY AND HOLD HARMLESS THE SPONSOR, EBAY INC., MARDEN-KANE, INC. AND EACH OF THEIR, AFFILIATES, SUBSIDIARIES AND THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS AND EMPLOYEES (COLLECTIVELY, "RELEASEES") FROM AND AGAINST ANY INJURIES, LOSSES, DAMAGES, CLAIMS, ACTIONS, OR ANY LIABILITY OF ANY KIND RESULTING FROM OR ARISING FROM PARTICIPATION IN THE SWEEPSTAKES, OR ACCEPTANCE, POSSESSION, USE, MISUSE OR NONUSE OF THE PRIZE THAT MAY BE AWARDED, OR BY AN EVENT OF FORCE MAJEURE OR ANY OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE PARTY AND WITHOUT ITS FAULT OR NEGLIGENCE SUCH AS ACTS OF GOD, ACTIONS BY ANY GOVERNMENTAL AUTHORITY, FIRES, FLOODS, WINDSTORMS, EXPLOSIONS, RIOTS, NATURAL DISASTERS, WARS, LABOR PROBLEMS, INABILITY TO OBTAIN POWER, FAILURES TO CONNECT TO THE INTERNET, NETWORK OR ELECTRIC FAILURES, MATERIAL, LABOR EQUIPMENT OR TRANSPORTATION. IF IN THE SPONSOR'S OPINION, THERE IS ANY SUSPECTED OR ACTUAL EVIDENCE OF ELECTRONIC OR NON-ELECTRONIC TAMPERING WITH ANY PORTION OF THE SWEEPSTAKES, OR IF COMPUTER VIRUS, BUGS, UNAUTHORIZED INTERVENTION, INCREASED WEB SITE TRAFFIC, FRAUD, OR TECHNICAL DIFFICULTIES OR FAILURES COMPROMISE OR CORRUPT OR AFFECT THE ADMINISTRATION, INTEGRITY, SECURITY, STABILITY, FAIRNESS, OR PROPER CONDUCT OF THE SWEEPSTAKES AND/OR ANY WEB SITE ASSOCIATED WITH THE SWEEPSTAKES, SPONSOR RESERVES THE RIGHT IN ITS SOLE AND EXCLUSIVE DISCRETION TO DISQUALIFY ANY INDIVIDUAL WHO TAMPERS WITH THE ENTRY PROCESS AND OR VOID ANY ENTRIES SUBMITTED FRAUDULENTLY, TO MODIFY OR SUSPEND THE SWEEPSTAKES, OR TO TERMINATE THE SWEEPSTAKES AND CONDUCT A RANDOM DRAWING TO AWARD THE REMAINING PRIZES USING ALL ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED AS OF THE TERMINATION DATE. ANY ATTEMPTS BY AN INDIVIDUAL TO ACCESS ANY WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES VIA A BOT SCRIPT OR OTHER BRUTE FORCE ATTACK OR ANY OTHER UNAUTHORIZED MEANS WILL RESULT IN THE PERSON AND IP ADDRESS BECOMING INELIGIBLE. USE OF AUTOMATED ENTRY DEVICES OR PROGRAMS IS PROHIBITED.
