There are 2 ways to play the eBay Treasure Hunt Instant Win Game:
(A) How to Play the Instant Win Game Online: The eBay Treasure Hunt Instant Win Game begins at 12:01 AM Pacific Time (PT) February 16, 2005 and ends at 11:59 PM PT February 23, 2005 ("Entry Period"). During the Entry Period, you can participate in the eBay Treasure Hunt Instant Win Game by doing the following: (1) Over the course of each day during the Entry Period, eBay Inc. ("Sponsor") will hide twenty-five (25) item listings within www.eBay.com or www.eBayMotors.com (each such listing a "Hidden Listing") (2) Over the course of each day during the Entry Period, Sponsor will post a clue related to each such Hidden Listing (the point at which the Hidden Listing and corresponding clue are posted during each day of the Entry Period shall be determined by Sponsor in its sole and exclusive discretion) at http://treasurehunt.ebay.com (the "Promotion Site"). (3) The clue and the answer to the clue will guide you through a search for the corresponding Hidden Listing featured on the applicable eBay Site. (4) The first person to find each Hidden Listing, click "Buy It Now" and follow the instructions provided to successfully complete the mock purchase* of the Hidden Listing will be the potential winner of the prize, pending verification of eligibility. From time to time, throughout the Entry Period, additional hints to the clues may be posted to the eBay community board at http://forums.ebay.com/db1/forum.jspa?forumID=2002, at the sole discretion of the Sponsor. Limit of one (1) eBay Treasure Hunt Instant Win Game prize per eBay User ID and/or person during the Entry Period. Each Hidden Listing will remain on the eBay Site until it is found or the Entry Period has ended, at which point the Hidden Listing will be removed. eBay.com and eBayMotors.com shall each be referred to herein as an "eBay Site". The then-current user agreements that govern use of the eBay Sites are hereby incorporated herein by reference.
*Please note that the Hidden Listing transaction is a mock purchase. You will not be purchasing the item advertised in the Hidden Listing, and you will not receive, or be charged for, the Hidden Listing. However, you must be the first to successfully complete the purchase process in order to receive the prize.
(B) To enter the eBay Treasure Hunt Instant Win Game by mail without using the Internet: Hand print your name, address, city, state, zip, e-mail address, eBay user ID (optional) and your day and evening phone numbers on a 3"x 5" card and mail in a #10 envelope to: "eBay Treasure Hunt Instant Win Game", P.O. Box 5000, Manhasset, NY 11030-5000. Non-winners will not be notified. Mail-in entries must be mailed separately and postmarked by February 23, 2005 and received by March 2, 2005. No mechanical reproductions of entries permitted. Odds of winning are 1:2,525. Odds based upon a total estimate of 500,000 game plays transacted and mail-in entries received over the Game Period; Actual odds of winning will depend upon the actual number of game plays transacted and mail-in entries received. In the event it is determined that a prize will be awarded to a mail-in entrant, winner will be selected in a random drawing from among all mail in entrants received during the Entry Period.
Limit twenty-five (25) eBay Treasure Hunt Instant Win Game entries per person and/or eBay User ID, per day, regardless of method of entry. Sponsor is not responsible for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, illegible entries or postage due mail. All entries become the property of the Sponsor and will not be returned. All information provided to Sponsor when registering for, and participating in, the Treasure Hunt Instant Win Game will be used in accordance with Sponsor's privacy policy located on the eBay Site.
Description of Prizes Awarded:
Instant Win Prizes: Two hundred (200) prizes will be awarded throughout the entire Entry Period as follows:
From February 16, 2005 through February 23, 2005, with the exception of February 21, 2005, One Hundred Seventy-Five (175) Prizes will be awarded. Each such prize will be One Thousand Dollars ($1,000) in cash to be deposited into each winner's account on www.PayPal.com (each a "PayPal Account"). Approximate Retail Value: $1,000 each.
On February 21, 2005, Twenty-Five (25) Prizes will be awarded. Each such prize will be Two Thousand Dollars ($2,000) in cash to be deposited into each winner's PayPal Account. Approximate Retail Value: $2,000 each.
Total Approximate Retail Value of Treasure Hunt Instant Win Game prizes: $225,000. All CLAIMED prizes will be awarded on or about 3/18/05. Prizes subject to availability and Sponsor reserves the right, at its sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. Taxes are the sole responsibility of the winners. Limit of one (1) Treasure Hunt Instant Win Game prize per person. No substitutions or transfers of prize permitted, except at Sponsor's sole discretion. If any winner does not have a PayPal Account, the winner will be required to go to www.PayPal.com (the "PayPal Site") and create a PayPal Account, subject to the terms of the then-current PayPal User Agreement at http://www.paypal.com/cgi-bin/webscr?cmd=p/gen/ua/ua-outside.
Eligibility:
The eBay Treasure Hunt Instant Win Game is open to confirmed registered members of www.ebay.com who are legal U.S. residents, 18 years or older at the time of entry (mail-in entrants need not be registered members of the eBay Site). You will not be eligible for the Instant Win Game if your account on any eBay Site or PayPal Site is not in Good Standing. In order for your accounts to be deemed in Good Standing as that term is used herein, you must not have a hold on any of your accounts and your accounts must not be suspended or past due as of February 23, 2005. Employees of eBay Inc. and its subsidiaries, affiliates, prize suppliers and advertising and promotion agencies, including Marden-Kane, Inc., and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win. Void in Puerto Rico and where prohibited by law. This Instant Win Game is subject to all applicable federal, state, local laws and regulations.
To Claim Prize/Notification:
Potential Treasure Hunt Instant Win Game prize winners will receive notification of prize won online at time of winning, subject to verification of eligibility. Marden-Kane will notify potential winners by email or telephone within seven (7) business days of winning the prize. Winners of prizes valued over $600 will be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, which must be returned within ten (10) days after issuance of prize notification or prize will be forfeited. Winners will be required to furnish their social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law. If prize notification is unclaimed or returned as undeliverable, or if a winner fails to properly sign and return all forms described herein, the prize will be placed into the Second Chance drawing described below. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any proper names, likenesses, eBay User IDs and photographs without further consideration or payment to the entrant online, in print, or in any other media for advertising and promotional purposes for this and similar promotions in all media (including and without limitation, the internet) without additional compensation, except where prohibited by law. All prize claims are subject to verification.
Second Chance Drawing:
Unclaimed and/or unawarded Treasure Hunt Instant Win Game prizes, if any, will be awarded in a Second Chance Drawing. To enter the second chance drawing hand print your name, address, city, state, zip, e-mail address, eBay user ID (optional) and your day and evening phone numbers on a 3"x 5" card and mail in a #10 envelope to: "eBay Treasure Hunt Second Chance Drawing", P.O. Box 6000, Manhasset, NY 11030-6000. Enter as often as you wish, but each entry must be mailed separately. Mechanically reproduced entries are not eligible. All entries must be postmarked by February 23, 2005 and received by March 2, 2005. All entries become the property of the Sponsor and will not be returned. Winner[s] will be selected in a random drawing on or about March 7, 2005 by Marden-Kane Inc., from all eligible entries received. Odds of winning will depend upon the number of Second Chance entries received and the number of unclaimed prizes available. Winners will be notified as detailed in Rule #4. The decisions of the judges will be final and binding on all matters relating to this Instant Win Game.
LIMITATION OF LIABILITY AND GENERAL TERMS AND CONDITIONS:

IF IN THE SPONSOR'S OPINION, THERE IS ANY SUSPECTED OR ACTUAL EVIDENCE OF ELECTRONIC OR NON-ELECTRONIC TAMPERING WITH ANY PORTION OF THE EBAY TREASURE HUNT INSTANT WIN GAME, OR IF COMPUTER VIRUS, BUGS, UNAUTHORIZED INTERVENTION, INCREASED WEB SITE TRAFFIC, FRAUD, OR TECHNICAL DIFFICULTIES OR FAILURES COMPROMISE OR CORRUPT OR AFFECT THE ADMINISTRATION, INTEGRITY, SECURITY, STABILITY, FAIRNESS, OR PROPER CONDUCT OF THE EBAY TREASURE HUNT INSTANT WIN GAME AND/OR ANY WEB SITE ASSOCIATED WITH THE EBAY TREASURE HUNT INSTANT WIN GAME, SPONSOR RESERVES THE RIGHT IN ITS SOLE AND EXCLUSIVE DISCRETION TO DISQUALIFY ANY INDIVIDUAL WHO TAMPERS WITH THE ENTRY PROCESS AND OR VOID ANY ENTRIES SUBMITTED FRAUDULENTLY, TO MODIFY OR SUSPEND THE EBAY TREASURE HUNT INSTANT WIN GAME, OR TO TERMINATE THE EBAY TREASURE HUNT INSTANT WIN GAME AND CONDUCT A RANDOM DRAWING TO AWARD THE REMAINING PRIZES USING ALL ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED AS OF THE TERMINATION DATE. ANY ATTEMPTS BY AN INDIVIDUAL TO ACCESS ANY WEB SITE ASSOCIATED WITH THIS EBAY TREASURE HUNT INSTANT WIN GAME VIA A BOT SCRIPT OR OTHER BRUTE FORCE ATTACK OR ANY OTHER UNAUTHORIZED MEANS WILL RESULT IN THE PERSON AND IP ADDRESS BECOMING INELIGIBLE. USE OF AUTOMATED ENTRY DEVICES OR PROGRAMS IS PROHIBITED.
NO MORE THAN THE LISTED NUMBER OF INSTANT WIN GAME PRIZES WILL BE AWARDED. IN THE EVENT OF A PRODUCTION, TECHNICAL OR HUMAN ERROR, OR FOR ANY OTHER REASON, THE NUMBER OF WINNING INSTANT WIN GAME LISTINGS DISTRIBUTED OR RECEIVED FOR ANY PRIZE LEVEL EXCEEDS THE NUMBER OF PRIZES LISTED IN RULE 2 FOR THAT LEVEL, SPONSOR RESERVES THE RIGHT TO CONDUCT A RANDOM DRAWING FROM AMONG ALL ELIGIBLE PRIZE CLAIMS RECEIVED TO AWARD THE LISTED NUMBER OF PRIZES.
