OFFICIAL RULES
NO PURCHASE NECESSARY. OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE AND OLDER AND WHO ARE PHYSICALLY LOCATED AND RESIDE IN THE UNITED STATES OR DISTRICT OF COLUMBIA; AND WHO ARE REGISTERED MEMBERS OF WWW.EBAY.COM and WWW.PAYPAL.COM. VOID IN PUERTO RICO, AND WHERE PROHIBITED. 1. ELIGIBILITY: No Purchase Necessary. The eBay Mobile Sweepstakes (the "Sweepstakes") is open to legal residents of the fifty United States and the District of Columbia, 18 years of age or older and who are physically located and reside in the United States or District of Columbia, and who are registered members of www.ebay.com and www.paypal.com in the U.S. ("Eligible Participant"). Membership is free. Void in Puerto Rico and where prohibited. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members, of PayPal Inc. ("Sponsor), eBay Inc., their respective parent companies (if any), affiliates, subsidiaries, divisions, advertising and promotion agencies, and prize partners, are not eligible to enter. Sweepstakes is subject to all federal, state and local laws. 2. SWEEPSTAKES TIMING/DESCRIPTION: The Sweepstakes begins at 12:00:00 AM Pacific Time (PT) on October 15, 2007, and ends 11:59:59 PM PT on November 30, 2007 (the "Promotion Period"). There will be daily drawings conducted throughout the Promotion Period and one (1) Grand Prize drawing conducted at the end of the Promotion Period. 3. HOW TO ENTER: There are two (2) ways to enter: (1) You will receive one (1) entry into a daily drawing and the Grand Prize drawing when you: (i) purchase an item listed on m.ebay.com by using your cell phone to place the winning bid or use Buy It Now for that item during the Promotion Period and (ii) pay for that item with your cell phone using PayPal Mobile during the Promotion Period. You will receive an entry for the day that you paid for the item you purchased, not on the day you placed a bid or used Buy It Now. Entries must be received by 11:59:59 PM PT on November 30, 2007 in order to be eligible for the Grand Prize drawing. Or, (2) ALTERNATE ENTRY: To receive an entry in a daily drawing and the Grand Prize drawing without making a purchase, print your name, address, city, state, ZIP code, and PayPal email address (optional) on a 3" X 5" card, and mail, in an envelope with postage affixed, to: eBay Mobile Sweepstakes, P. O. Box 842, Bethpage, NY 11714-0842. You may enter by mail as often as you wish, but each entry must be mailed separately. Limit one entry per PayPal member per day, regardless of entry method. A "day", for purposes of this Sweepstakes, is defined as the 24-hour period beginning 12:00:00 AM PT and ending at 11:59:59 PM PT of the same day. Subsequent entries received from the same PayPal member on the same day will be disqualified. Mail-in entries must be postmarked by November 30, 2007 and received by December 6, 2007 in order to be eligible for the Grand Prize Drawing. Entries must be received by dates and times stated in the Entry Chart below in order to be eligible for each daily random drawing. Entrants may enter only by using one of the entry methods described in these rules. Entries that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. Entries become the property of the Sponsor and will not be acknowledged or returned. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. If a dispute results as to the identity of an online entrant, it will be determined that the online entry was submitted by the authorized account holder of the PayPal account from which the entry is made. Non-winning daily entries are not eligible for subsequent daily drawings. 4. DETERMINATION OF WINNERS: One (1) Grand Prize winner will be selected in a random drawing on or about December 10, 2007 from among all eligible entries received during the Promotion Period. Five (5) Daily Prize winners will be selected in a random drawing from among all eligible entries received as stated in the Daily Drawing Chart above. The random drawings will be conducted by an independent judging organization. Judges decisions are final on all matters relating to this Sweepstakes. Potential Grand Prize Winner will be notified by electronic mail or overnight or U.S. mail on or about December 12, 2007. Daily Prize Winners will be notified by electronic mail or overnight or U.S. mail on or about the dates stated in the Daily Drawing Chart above. Potential Grand Prize Winner will be required to sign an affidavit of eligibility/liability release and where legal, publicity release and federal and state tax release and return these documents, properly executed, via overnight mail, within 7 days of issuance of notification. Non-compliance within this time frame, or if prize or prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will be awarded to a potential alternate winner. Odds of winning a Daily Prize depend upon the number of eligible entries received each day. Odds of winning a Grand Prize depend upon the total number of eligible entries received during the Promotion Period. Limit one Daily Prize per PayPal member. 5. PRIZES: One (1) Grand Prize: $10,000 deposited into winner's PayPal account and an Apple® 8GB iPhone™. Carrier subscription is not included with iPhone™ prize. ARV: $10,399. Daily Prizes (235 - five (5) awarded each day for 47 days): $100 deposited into winner's PayPal account. ARV: $100/each. Total approximate retail value of all prizes is $33,899. All Winners must have a PayPal Account to receive prize and to access and use the prize. Prize will be deposited in the PayPal account associated with the email address you provided. If the email address you provided is not associated with your PayPal account, you must associate it with your PayPal account within 7 days from time of prize notification to qualify. Membership to PayPal is free. Potential winners with a PayPal account must have their account in good standing in order to receive a prize. Prizes will not be awarded to potential winners with locked, closed or restricted accounts. All taxes and any other costs and expenses not specifically stated within these Official Rules are the sole responsibility of the winners. Prizes may not be transferred, substituted or redeemed for cash, except at the Sponsor's sole discretion. Specifics of the prizes are in Sponsor's sole discretion. Prizes are subject to availability and Sponsor reserves the right, in its sole discretion, to award a prize of equal or greater value if advertised prizes are unavailable. Any and all guarantees and warranties on merchandise prize are subject to the manufacturer's terms and conditions, and winner agrees to look solely to such manufacturer for any such warranty or guarantee claim. All prizes will be awarded. Allow 4-6 weeks for delivery of prize. 6. CONDITIONS OF PARTICIPATION: All materials submitted in connection with the Sweepstakes become the property of the Sponsor and will not be returned. By participating, entrants agree to be bound by these Official Rules including all eligibility requirements. By accepting a prize, winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material for advertising, publicity and promotional purposes by Sponsor, or a party designated by the Sponsor, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Entrants agree to abide by the terms of these Official Rules and the decisions of the judges, which are final and waive any right to claim ambiguity in these Official Rules. Entrants agree that any and all disputes shall be governed by the laws of the State of California and that personal jurisdiction shall exclusively be the state and federal courts located in Santa Clara, California. 7. LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS PAYPAL INC. ("SPONSOR"), EBAY INC., THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, DIVISIONS, ADVERTISING AND PROMOTION AGENCIES, AND PRIZE PARTNERS, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES AND SHAREHOLDERS (COLLECTIVELY, THE "RELEASEES") FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THE SWEEPSTAKES OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE SWEEPSTAKES OR THE PRIZES AWARDED. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, RELEASEES DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO ANY PAYPAL WEB SITE AND RELEASEES SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. Releasees are not responsible for lost, late, incomplete, illegible, inaccurate, delayed, garbled, damaged, postage due or stolen entries or mail or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, submit an online registration form, complete a PayPal Mobile or eBay Mobile transaction, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes at any time without notice, if in the judges' opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Sweepstakes or for any other reason in its sole discretion. In such event, Sponsor may void any entries they suspect are at issue and award prizes from among all non-suspect eligible entries received up to the date of cancellation. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR ANY ONLINE SERVICE RELATED TO THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant's eligibility to participate in the Sweepstakes. Any attempts by an individual to access any website associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited. 8. WINNERS' LIST: For the names of the winners, available after December 31, 2007, mail a self-addressed, stamped envelope by December 31, 2007 to: eBay Mobile Sweepstakes Winners, P.O.
