The eBay Motors Sun & Speed Summer Sweepstakes ("Sweepstakes") begins at 12:00 01 AM (PT) July 11 and ends at 11:59:59 PM PT July 25, 2002 ("Promotional Period")

1. To Enter: You will be entered automatically when you visit http://pages.ebay.com/ebaymotors/summer and complete and submit the official entry form online. Incomplete entries are not valid. Only one entry per person. Subsequent entries from the same person will be disqualified. All entries must be submitted by 11:59:59 PM (PT) on July 25, 2002. Entries, and the use of information provided by entrants to eBay Inc. ("Sponsor") therein, will be subject to Sponsor's privacy policy and user agreement posted at the eBay website located at www.ebay.com (the "eBay Site").

2. Drawing: On or about July 27, 2002, a random drawing will be conducted by Marden-Kane, Inc., an independent judging organization, from among all eligible entries received. All prizes will be awarded. Only one prize per person, family or household.

3. Odds: Estimated odds of winning are 1:10,000 however, the actual odds of winning depend upon the total number of actual eligible entries received.

4. Prizes: One (1) Grand Prize will be awarded: A 2002 Chevrolet Avalanche 1500 ½ Ton 4WD North Face Edition with standard factory equipment, and a Bombardier Sea Doo GTX4-TEC and Trailer. Approx. Retail Value (ARV) $48,599.00. One (1) First Prize will be awarded: A 2002 Indian Chief Deluxe Motorcycle with standard factory equipment. ARV $21,975.00. Total ARV of all prizes: $70,574. Winners must furnish proof of the appropriate insurance in order to receive the prize. No prize substitutions, cash equivalents, or transfer of prizes permitted except that the Sponsor, at its sole discretion, may substitute a prize of equal value for any reason. Prizes awarded subject to availability. Winners are responsible for payment of all taxes on prizes, title, registration and license fees, and any other expenses relating to the acceptance and use of the prize not specified herein. Any depiction of prizes is for illustrative purposes only.

5. Eligibility: Sweepstakes open to all legal U.S. residents in the 50 United States and the District of Columbia, 18 years of age and older as of the date of entry. Employees of Sponsor, its subsidiaries and affiliates, and the advertising and promotion agencies of Sponsor including Marden-Kane, Inc. and its affiliates, and the immediate families (spouse, parents, children and siblings, and each of their respective spouses, regardless of where they live) and persons living in the households of such individuals, whether related or not, are not eligible to participate. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to abide by and be bound by these Official Rules, agree to waive any right to claim ambiguity in the rules, and agree to accept the decisions of the Sponsor and Marden-Kane, Inc. as final in all matters relating to the Sweepstakes.

6. Winner Notification: All potential winners will be notified by certified mail, return receipt requested and may be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, and furnish his/her social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law, which must be returned within 14-days from prize notification date or the prize will be forfeited and awarded to an alternate winner[s]. In addition, potential winners will be required to furnish proof of the appropriate insurance in order to receive the prize. If the prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and awarded to an alternate winner[s]. If an entrant changes his/her telephone number and/or address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to the Sweepstakes Administrator address (listed below) to be received by the end of the Promotional Period. By entering the Sweepstakes entrants agree to the use of their name and photograph/likeness for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law.

7. Limitation of Liability: By participating in the Sweepstakes entrants agree to release, indemnify and hold harmless eBay Inc., Marden-Kane, Inc. and their parent companies (where applicable), and any and all their affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, "Releasees") from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize that may be awarded. Entrants agree that any and all disputes shall be governed by the laws of the state of California. Winners agree to accept the prizes "as is", and entrants hereby acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize.

Releasees are not responsible for printing or typographical errors in any Sweepstakes related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this promotion, or process any transaction thereon. If in the Sponsor's opinion, there is any suspected or actual evidence of use of automated entry devices or programs or electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Sweepstakes or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all non-suspect entries received as of the termination date. Sponsor reserves the right to modify or terminate the Sweepstakes in its entirety at any time, and for any reason, at Sponsor's sole discretion. Should the Sweepstakes be modified or terminated prior to the stated expiration date, notice will be posted at www.ebaymotors.com/summer. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this promotion via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
